That is not a hypothetical. That is the governance reality of brain-computer interfaces in 2025, and it is arriving faster than the rule books can be rewritten.
The accelerating commercialization of neurotechnology, driven in no small part by Neuralink's high-profile human trials and a broader surge of venture capital into companies like Synchron, Blackrock Neurotech, and Precision Neuroscience, has shoved an uncomfortable question to the front of the policy queue: who, exactly, is in charge of governing a device that sits at the intersection of medical implant, consumer electronics, and artificial intelligence data pipeline?
A Three-Agency Tangle and a Missing Rulebook
In the United States, the Food and Drug Administration has historically treated implantable neural devices as Class III medical devices, the highest risk category, requiring the most stringent premarket approval process. Neuralink received its Breakthrough Device Designation in 2023 and subsequently launched its PRIME study, enrolling patients with severe paralysis to test the N1 chip's ability to translate neural signals into computer commands. The International Standards Race and Why It Matters More Than You Think
While domestic regulatory agencies debate jurisdiction, the international standards arena is where the longer-term governance architecture is actually being built, and the race to define those standards is intensely geopolitical. The International Electrotechnical Commission and the IEEE are both actively developing technical standards for neural interface safety, interoperability, and data formats. What Good Governance Actually Looks Like
A cohesive governance framework for BCIs would need to accomplish several things simultaneously that current structures handle separately or not at all. It would need to track devices across their full lifecycle, from implantation through potential obsolescence and explantation, with clear liability assignments at each stage. It would need to define neural data as a distinct category with specific consent, storage, and transferability rules that cannot be waived by a terms-of-service click. It would need to establish international interoperability standards through diplomatic channels with the same urgency currently applied to semiconductor supply chains.
Several policy researchers advocate for a dedicated Neurotechnology Regulatory Office, housed within the FDA but with formal coordination mandates with the FTC, FCC, and relevant national security bodies, specifically to prevent the jurisdictional fragmentation that has allowed the current governance gap to persist. A 2024 report from the Neurorights Foundation proposed an analogous international body modeled loosely on the International Atomic Energy Agency, an independent agency with inspection authority and standard-setting power, calibrated to the specific dual-use risks of technology that can both restore human function and surveil human cognition.
None of these solutions are simple. All of them face opposition from industry actors who profit from the current ambiguity. But the governance window is narrow.
